What to check before renting a room

Most deposit disputes come down to three things nobody agreed on at the start. All three can be settled on the day you sign.

1. Who is on the other side of the contract

Check whether you are signing with the owner or manager of the flat, or with an agent who will charge a commission. Ask this before the first viewing — the answer changes your move-in cost by half a month's rent.

2. What exactly the utilities cover

A fixed amount or a meter settlement? Is internet included? Is heating reconciled once a year? The worst arrangement is an advance payment with no stated rate, because then you have no idea what spring will bring.

3. A handover protocol with photographs

This is what decides whether you get your deposit back. Record the state of the room when you move in and take photos — a scratch that was there before you stops being your problem. A refusal to write a protocol is itself an answer about who you are dealing with.

4. The terms and deadline for returning the deposit

The contract should state when the deposit comes back and what may be deducted from it. Ordinary wear and tear is not damage — that is settled interpretation of Polish tenancy law, not a matter of goodwill.

5. Notice conditions

Check whether the contract is for a fixed term and what happens if you have to leave early. A well-written contract plans for that instead of pretending it never happens.

6. Who else lives there

In a shared flat this matters more than the floor area. Ask how many people, how old they are and whether they study or work. We state it openly on every one of our offer pages.

Frequently asked questions

Can the landlord keep the deposit for ordinary wear and tear?

No. Ordinary wear resulting from normal use is not damage and is not a ground for deducting anything from the deposit.

Does a room rental contract have to be in writing?

A contract for longer than a year must be in writing. Regardless of the rules, a written contract is the only thing you can rely on in a dispute about the deposit.

What belongs in a handover protocol?

The condition of walls, floor and furniture, the meter readings, the number of keys handed over, and photographs. Both sides sign it on the day the room is handed over.
